032726 Tell Congress: Protect The Right To Due Process

A federal appeals court just ruled that immigrants living in the United States — some for decades — can be locked up indefinitely with no bond hearing, no judge, no chance to argue for release.

The 2-1 ruling overturns 30 years of practice — including during Trump's first term — and could affect hundreds of lower court cases across seven states.

The case centers on Joaquin Herrera Avila, a man with nearly 20 years in the U.S. and no serious criminal record, arrested at a traffic stop in Minneapolis. A district judge said he deserved a hearing. The 8th Circuit said no. Even a Trump-appointed judge dissented, calling it a "novel interpretation" that "eluded the courts and five previous presidential administrations."

The 5th Circuit reached the same conclusion last month. The 7th Circuit has yet to rule. And now, a Supreme Court showdown is coming.

But we shouldn’t have to wait for the courts to catch up. Congress can act right now. Tell your representatives to pass legislation guaranteeing bond hearings for immigrants in removal proceedings — no exceptions.
